Investment Fees: Contract Search
Rule

  1. The non-refundable $7500.00 (Hotel Positions) / $15,000.00 (Corporate Positions) retainer portion of the fee for the services of Ferree & Associates is due prior to our starting the search. The contingency portion of the fee is due when a candidate is engaged to perform services, directly or indirectly, by the employer, any of its affiliates or through subsequent referrals.

  2. The contingency search fee for the services of Ferree & Associates is thirty percent (30%) of the estimated annual gross earnings at the time the candidate accepts employment. To the extent said earnings are based upon commissions, bonuses, additional inducements or incentives, we reserve the right to determine a reasonable estimate of the amount which would otherwise be received for the purposes of computing the fee. The $7500.00 (Hotels) or $15,000.00 (Corporate) paid at the start of the search will be deducted from the final fee. If no one is hired through the efforts of Ferree & Assoc., Inc., then the $7500.00 or $15,000.00 will be considered as payment in full for our services.

  3. The final fee is due upon receipt of the invoice.

  4. In the event litigation arises surrounding this Schedule of Fees or the terms herein, the prevailing party shall be entitled to reasonable attorney's fees, costs and other necessary and proper expenditures in addition to whatever other relief may be awarded.

  5. In the event a candidate hired as a result of the efforts of Ferree & Associates terminates the employer voluntarily or is terminated for cause within one hundred twenty (120) calendar days after employment commences, we will endeavor to replace said candidate for the same position and with the same compensation without additional charge, or issue a credit for the fee due upon another placement with the employer within twelve (12) months from the date of termination. This guarantee shall only be in effect if our full fee has been paid within twenty (20) calendar days from the date of the invoice, and a request for replacement is received within ten (10) calendar days from the date of termination.

  6. Ferree & Associates will refer qualified candidates without regard to race, color, national origin, religion, sex, age, marital status, or disability.

We have requested resumes from Ferree & Associates and agree to the terms above for any applicant we employ through the efforts of Ferree & Associates. The undersigned is authorized to enter into this agreement.
